1. Provider

2. Scope
These terms govern all orders placed via wald.supply between WALD and the customer. Checkout, payment and order processing are handled by Shopify; Shopify's terms apply to the technical checkout in addition to these terms. We only contract with consumers and businesses with a delivery address in the European Union, United Kingdom and Switzerland unless otherwise agreed.
3. Products
Every WALD piece is upcycled from reclaimed outdoor and workwear and produced in very limited quantities — typically as a one-of-one. Colour, wear marks, stitching and minor irregularities are part of the character of the garment and not defects. Product photos are indicative; slight deviations are possible.
4. Contract formation
The presentation of products in the shop is an invitation to submit an offer. By clicking the order button at checkout you submit a binding offer. A contract is formed when we confirm the order by separate email (order confirmation), at the latest when we ship the goods.
5. Prices and payment
All prices are end prices in EUR and include statutory VAT. Shipping costs are shown at checkout before you submit your order. Payment methods available at checkout are enabled via Shopify Payments and the payment providers we offer; payment is due immediately on order.
6. Delivery
Delivery is made to the address provided at checkout via the carrier we select. Standard dispatch is within 5 working days after receipt of payment unless stated otherwise on the product page. Risk of loss passes to consumers on handover of the goods; to businesses on handover to the carrier.
7. Right of withdrawal (consumers, EU)
Consumers have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day on which you, or a third party other than the carrier indicated by you, acquires physical possession of the goods. To exercise the right of withdrawal, you must inform us (WALD SUPPLY GmbH, info@wald.supply) by an unequivocal statement (e.g. an email).
Effects of withdrawal: If you withdraw, we will reimburse all payments received from you, including standard delivery costs, without undue delay and not later than 14 days from the day on which we are informed of your decision. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent them back, whichever is earlier. You must return the goods without undue delay and not later than 14 days from the day on which you communicate your withdrawal. You bear the direct cost of returning the goods. You are only liable for any diminished value resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
8. Warranty
Statutory warranty rights apply (§§ 434 ff. BGB). The characteristics of upcycled goods described in section 3 do not constitute defects.
9. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act, and within the scope of any guarantee given. For simple negligence we are only liable for the breach of material contractual obligations (cardinal obligations); liability is then limited to foreseeable, contract-typical damage.
10. Dispute resolution
The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
11. Governing law and venue
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers this choice of law applies only insofar as it does not deprive the consumer of mandatory protections under the law of their country of habitual residence. Place of jurisdiction for disputes with merchants is Hamburg.
12. Severability
Should any provision of these terms be or become invalid, the validity of the remaining provisions shall not be affected.
